Apple Rebuffed, Samsung Warned, in Busy Trial Day


It was an eventful day in the ongoing patent trial between Apple (AAPL) and Samsung Electronics in federal court in San Jose, California.

Bloomberg‘s Joel Rosenblatt and Adam Satariano this afternoon report that judge Lucy Koh rejected Apple’s request yesterday that she impose sanctions upon Samsung for having publicly revealed past Apple prototypes for its iPhone, evidence that had not been admitted to the trial. Koh said she may investigate Samsung’s conduct at a later point but denied Apple’s motion.

The authors write that Koh also refused Apple’s requests to seal data about Apple sales by country, which Apple maintained was “protected trade secrets.”

Reuters’s Poornima Gupta relates the testimony on the stand today of Apple’s chief marketing officer Phil Schiller, who discussed how Apple seeks to “make the product the biggest and clearest thing in advertising” as a general approach to each new thing it creates. Apple has spent $647 million to advertise the iPhone since its introduction in 2007, Schiller revealed. The company has spent $457 million on iPad marketing.

And articles today fixed on the attitude of Apple toward the category of tablet computers that are smaller than the iPad’s 10-inch screen.

Although it’s been mentioned repeatedly that late founder Steve Jobs remarked such smaller tablets were going to fail, The Financial Times‘s Tim Bradshaw today writes that Jobs and other executives “discussed approvingly the idea of a smaller iPad to compete with Samsung’s 7-inch galaxy Tab early last year.” The Galaxy Tab, like Samsung’s “Galaxy S III” smartphone, runs Google‘s (GOOG) Android operating system.

The proximate cause of that observation was an email from Apple iTunes guru Eddy Cue from 2011 to Steve Jobs in which Cue remarked that “I believe there will be a 7-inch market and we should do one.”

Apple shares today roe $7.91, or 1.3%, to close at $615.70. Samsung shares in Seoul trading fell 1.6% to close at ₩1,243,000.
